As states look for ways to raise money to pay for roads and bridges, the Texas Department of Motor Vehicles (DMV) may have hit on a solution. In June, the Wall Street Journal reported that Texas authorized the nation’s first auction of vanity license plates. PennDOT Audit Process Checklist

When an audit is conducted at an issuing agent’s place of business, the Department of Transportation (PennDOT) checks for the items in the following list. PennDOT recommends agents review this list and make sure their offices are in proper order.

  • Issuing agent’s certificate of authorization
  • Issuing agent’s executed contract with PennDOT
  • Current criminal history reports for all employees, as applicable
  • Current affidavits for all employees, as applicable (see Note)
  • Training certificates for all employees, as applicable
  • Posted schedule of fees, including PennDOT processing fees
  • Posted hours of operation
  • Accurate inventory of registration plates/permits
  • Secure storage of temporary registration cards/plates/permits
  • Receipts showing total fees pay able to the Commonwealth of Pennsylvania and fees charged by the agent
  • Temporary registrations/plates – Forms MV-1/MV-4ST
    • Issuing agent’s yellow copies of Forms MV-1 and/or MV-4ST; copies of fronts and backs of titles; copies of valid proofs of identification (government-is sued ID); copies of proofs of insurance; copies related to title transfers.
    • If a registration was issued, agent’s copies for each transaction must be filed in consecutive order by plate number. If a registration card only was issued, agent’s copies for each transaction must be filed in chronological order by date of issuance.
    • All information on applications must be completed.
    • If Form MV-3 is attached, it must show the references used to verify the fair market value of the vehicle (i.e., NADA Guide, Kelly Blue Book, etc.).
  • In-transit plates – Form MV-120
    • Copies of out-of-state drivers’ licenses; proofs of insurance; proofs that vehicles were purchased in  Pennsylvania within 60 days (for example, copies of certificates of title or manufacturer’s certificates of origin, properly assigned to the applicant).

Here’s how to avoid the most common problems discovered during an audit:

  • Organize your files properly with plate issuances separate from plate transfers.
  • Keep window permits in booklet form, not in files.
    • Make front and back copies of all documents, including IDs; make sure all supporting documents are copied and attached.
    • Complete all forms in their entirety, including driver’s license numbers and agent ID numbers.
    • Complete the required basic or refresher training and keep current certificates on file.
    • Report to PennDOT when employees leave your business or you gain additional employees.
    • Do not accept out-of-state drivers’ licenses or IDs, fraudulent IDs or no IDs to title and register vehicles in Pa. Accept only the forms of ID listed on PennDOT’s fact sheet, “Acceptable Proof of Identification Documents for Completing Motor Vehicle Forms.”
    • Verify the vehicle identification number (VIN) when required.
    • Obtain the proper authorizations to perform online inquiries of driver and vehicle records.
    • Submit all paperwork on time.

Note: Under contract terms, agents and messengers and their employees must execute annual affidavits stating that they have read and understand the sections of the Pennsylvania Consolidated Statutes and the Pennsylvania Code that apply to motor vehicle transactions. Messengers and their employees must also swear or affirm that they have read PennDOT’s Messenger Manual.

Seasonal Vehicle Registration

Section 1307(a.1) of the Vehicle Code allows an owner or lessee to register a passenger car, recreational motor vehicle, motorcycle, truck or farm vehicle weighing 9,000 pounds or less for less than a full year [75 Pa.C.S. §1307(a.1)]. The vehicle cannot be driven during the period when it is not registered; Section 1301(a) of the Vehicle Code prohibits driving an unregistered vehicle unless the vehicle is exempt from registration [75 Pa.C.S. §1301(a)]. However, the vehicle does not have to be insured for the part of the year when it is not registered. Thus, seasonal registration allows you to drop your vehicle insurance for part of each year without having to return the registration plate to PennDOT. [Read more...]

Verifying Signatures in Lieu of Notarization

Pennsylvania’s Vehicle Code allows issuing agents who are dealers licensed by the State Board of Vehicle Manufacturers, Dealers and Salespersons and who have 85, 86 or 87 Dealer Identification Numbers (DINs) or the dealer’s employees to verify signatures in lieu of notarization. With the passage of Act 50 of 2005, any wholesale vehicle auction licensed by the State Board of Vehicle Manufacturers, Dealers and Salespersons and the auction’s employees may also verify a person’s signature in lieu of notarization. Driver and Vehicle Services Updates

The Pennsylvania Department of Transportation (PennDOT) issued two “Special Edition” Driver and Vehicle Services (DVS) Update Bulletins in June 2011.

Bulletin No. 11-2 – New Electronic Tracking System for In-Transit Tags

PennDOT is developing an electronic vehicle information system to input, track and validate in-transit tags. Deployment of the system is targeted for October 2011.

After deployment of the system, manual issuance of in-transit tags will no longer be permitted. PennDOT contracted agents who wish to continue to issue in-transit tags will be required to participate in one of PennDOT’s on-line programs to use the electronic tracking system:

Bulletin No. 11-3 – Expired Plate/Pink Slip

It is legal for a vehicle to be operated on a pink slip, if the registration plate is expired, provided the registration renewal fee was listed on the pink slip and the pink slip is still valid (within 90 days of the transfer).

The registration fee paid to renew the expired plate must be listed in Section I of Form MV-1 – Application for Certificate of Title or Form MV-4ST – Vehicle Sales and Use Tax Return/Application for Registration, or the authorized agent must certify that the renewal fee was collected in Section C of Form MV-120 – Temporary Cardboard In-Transit Registration Plate Card or Temporary Registration Transfer Card.
